This Anti-Spam Policy (“Policy”) outlines the rules and restrictions surrounding the use of email, SMS, push notifications, automated outreach tools, AI-generated messages, marketing automation, and communication features offered by UgenticAI, Inc., including all subsidiaries, affiliates, and partner-operated platforms (“UgenticAI,” “we,” “our”). Our goal is to ensure compliance with global anti-spam laws and to protect users from unwanted or harmful communications.

1. Zero-Tolerance Policy for Spam. UgenticAI maintains a strict zero-tolerance stance toward spam. Users may NOT use UgenticAI Services to send:

  1. unsolicited emails
  2. unsolicited SMS or phone calls
  3. deceptive or misleading messages
  4. bulk messages without proper consent
  5. messages violating privacy or communication laws

Spam is strictly prohibited and grounds for immediate suspension or account termination.

2. Compliance With Global Laws. This Policy ensures compliance with:

3. Consent Requirements. Users must obtain valid consent before sending any communication through UgenticAI systems.

3.1 Email Consent. Acceptable forms of consent include:

  1. explicit opt-in through a form
  2. double opt-in (recommended)
  3. transactional relationships that legally allow communication

3.2 SMS Consent (Stricter Regulation). SMS requires express written consent, which must:

  1. clearly state the program
  2. include frequency/automated nature
  3. include opt-out mechanism
  4. be stored by the sender

Users are prohibited from uploading purchased, scraped, guessed, or harvested phone numbers.

4. User Responsibilities When Sending Messages. Users must:

  1. identify themselves accurately
  2. provide correct sender information
  3. include a valid business name, address, and contact information
  4. include a working unsubscribe or STOP mechanism
  5. immediately honor unsubscribe requests
  6. use truthful subject lines and message content
  7. comply with hourly/daily send-volume limits
  8. avoid misleading, deceptive, or fraudulent content

5. AI-Generated Outreach (Important). UgenticAI prohibits misuse of AI systems to:

  1. mass-generate unsolicited outreach
  2. impersonate individuals without consent
  3. create deceptive marketing messages
  4. bypass platform throttling, rate limits, or consent rules
  5. scrape or harvest contact data for outreach
  6. generate messages intended to mislead or manipulate recipients

All AI-generated outreach must follow:

  1. consent laws
  2. transparency expectations
  3. accurate sender identification
  4. appropriate frequency

6. Prohibited Spam-Related Activities. The following are strictly forbidden:

  1. buying or renting contact lists
  2. sending emails to users who did not opt-in
  3. using misleading subject lines (“RE:”, “FWD:” when not applicable)
  4. rotating IPs or domains to bypass spam filters
  5. forging email headers
  6. scraping social media or websites for contact info
  7. bypassing unsubscribe links
  8. sending bulk cold outreach without explicit consent
  9. SMS blasting without express written consent

7. Unsubscribe / Opt-Out Requirements. All communications must include:

  1. a functional, one-click unsubscribe link (email)
  2. a STOP or UNSUBSCRIBE command for SMS
  3. immediate removal from all marketing lists within:
    1. 10 business days (email)
    2. 24 hours (SMS)

Users may NOT:

  1. charge fees for unsubscribing
  2. require login or multiple steps
  3. conceal or obscure opt-out instructions

8. Monitoring & Enforcement. UgenticAI may:

  1. monitor outgoing communication sent via its systems
  2. flag accounts with abnormal send patterns
  3. rate-limit or throttle delivery
  4. suspend accounts suspected of sending spam
  5. terminate accounts repeatedly violating this Policy
  6. investigate complaints submitted by recipients or ISPs

Repeated or severe violations may lead to:

  1. permanent access revocation
  2. reporting to carriers, ISPs, and regulatory bodies
  3. legal claims or damages where required

9. Reporting Spam. If you receive spam that appears to originate from a UgenticAI user: Report it to: compliance@ugenticai.com
Please include:

  1. sender address
  2. message content
  3. timestamp
  4. any available headers or metadata

We investigate all reports promptly.
10. Penalties for Violations. Violating anti-spam laws may result in:

  1. account suspension or termination
  2. financial penalties imposed by regulators (CAN-SPAM fines, TCPA statutory damages, CASL penalties)
  3. legal liability for the sender
  4. recovery actions by UgenticAI for damages to our systems or reputation

Nothing in this Policy limits UgenticAI’s rights under our Terms of Use or AUP.

11. Changes to This Policy. We may update this Policy periodically. The “Last Updated” date reflects the most recent version.
